One significant example of this integrated approach was the case involving Lucky Phounsy, a 32-year-old man who passed away in 2015 after a call to 911 during a mental health crisis. The incident involved a series of interactions with law enforcement that led to his hospitalization and eventual death.

Representing the family, Tim Scott served as lead trial counsel in a wrongful death and civil rights lawsuit. In March 2022, a jury awarded the family $85 million. At the time, it was one of the largest verdicts in a case involving an in-custody death.

“This case reflected the importance of accountability within the justice system,” Scott said following the verdict.

Broader Legal and Community Impact

The Phounsy verdict brought attention to several practices and procedures used during mental health interventions. It also highlighted issues surrounding the use of certain restraint techniques and underscored the need for clarity and transparency in law enforcement policies.

During the litigation process, disclosures related to training procedures were reviewed, and the case drew focus on the significance of institutional responsibility in high-stakes situations.
